The following Terms and Conditions are an essential and integral part of the driving lessons offered by Purple Driving School and having its office at 1 Mychell House, Pincott Road, London, SW19 2NN.

All our member instructors (hereinafter “Purple Driving Instructor”) are self employed independent contractors and it is hereby expressly agreed that the contract for tuition is made solely between the Purple Driving School and yourself.

Please ensure you check ALL of the boxes below in order to be eligible for taking driving lessons with a qualified Purple Driving Instructor.

• I am a resident of the United Kingdom
• I am 17 years of age or older (16 years of age for moped training)
• I hold a valid, provisional driving license for Northern Ireland or Great Britain
• I understand if I fail to provide evidence of all three of the above, the WeTrust Driving Instructor is entitled to refuse to conduct the driving lesson but may still charge me for it.

The timing, location and duration of all driving lessons are to be mutually decided and determined by the Purple Driving Instructor and yourself, including prior confirmation before each lesson and/or request for rescheduling as and where applicable.

You must immediately notify the Purple Driving Instructor of any issue that may affect your ability or entitlement to have driving lessons, for example, but not limited to, any lack, or loss, of a valid driving license.

It is the responsibility of the Purple Driving Instructor to decide when you are ready to take your practical test and Purple Driving School does not accept any responsibility for this decision.

The price per hour for driving lessons will remain fixed at the price that was originally agreed in your contract of tuition, unless communicated otherwise. All payment for tuition should be made directly to the Purple Driving Instructor via their preferred mode of payment as originally agreed in your contract of tuition. Any block booking must be used within 6 months of purchase, and you will not be entitled to any refund for any lessons that are not booked and used within this 6-month period.

All bookings, payments, adjustments, refunds and documentations pertaining to processing of such money will be held strictly by and between yourself and the Purple Driving Instructor, and Purple Driving School hereby expressly disclaims any and all liability arising from the same. However, nothing in these terms shall exclude the liability of the Purple Driving School for any loss or damage directly occasioned by the negligence or other breach of the said company.

The cost of the driving test is £62, which is payable directly to the UK Driver and Vehicle Standards Agency (DVSA) and is not a part of any of the packages offered on our Website and/or social media pages. This also applies to the theory test charge of £23.

Short Notice Cancellations:

Any request for cancellation or rescheduling of a pre booked driving lesson must be made directly to the Purple Driving Instructor, preferably at least 48 hours before the scheduled start of the lesson. Any cancellation made inside 48 hours notice is chargeable in full by the Purple driving instructor as he/she loses the slot and wouldn’t be able to book someone else at short notice. Similarly, in the event the Purple Driving Instructor is unable toattend a pre-booked driving lesson, and/or make alternative arrangements for the same, they will notify you at their earliest opportunity. Notwithstanding the above, you acknowledge and agree that each driving lesson is a contract exclusively between you and the Purple Driving Instructor and Purple Driving School will not be liable for, or otherwise entertain any claim brought by you resulting from such cancelled lessons.

Cancellation of your Driving Test by the test centre on the day of the test may be eligible for a full/partial refund. If you miss your Driving Test owing to your negligence, for example, but not limited to, reporting at the wrong test centre or at the wrong test day, such refund may or may not be available. Please clarify with your Purple Driving Instructor and the contract of tuition that you have signed with them to know more about the availability or non-availabity of your rights in such a situation.

SPECIAL TERMS AND CONDITIONS FOR COVID-19

In view of the ongoing pandemic of novel coronavirus (COVID-19) additional safety measures have now been made mandatory and non-adherence to the same may result in cancellation of your driving lesson at the sole discretion of the Purple Driving Instructor. Wearing of masks and sanitisation of hands prior to the beginning of each driving lesson is compulsory and non-negotiable. The Purple Driving Instructor may also ask you specific questions regarding the status of your health and take your temperature by a non-contact body thermometer to ascertain your fitness for the lesson on a regular basis. Any cancellation due to Covid-19 will need appropriate proof of medical certificate / negative report along with undergoing the Government recommended isolation procedure before the driving lesson can be resumed again.

Driving Instructors Terms:

The following Terms and Conditions are an essential and integral part of your agreement with Purple Driving School, a trading name of Rashid Mustafai and having its office at 1 Mychell House, Pincott Road, London, SW19 2NN (“we” or “us”).

We are a Greater London Wide Community of Trusted Driving Instructors who operate their own independent driving instruction businesses. By accepting these Terms and Conditions, you voluntarily agree to be a part of our community as a self- employed independent contractor without the requirement of any long-term commitment or payment obligation.

Once you join driving school, we will be matching all incoming booking requests of prospective Pupils with you based on mutual choices such as the mode of operation of the driving vehicle (manual or automatic); time of the driving lesson (weekday/ weekend/ daytime/ evening); area of residence etc. Once we find an appropriate match, we will contact you to enquire your willingness to accept the new Pupil, and upon confirmation, share all necessary details via your preferred mode of communication.

YOUR ASSOCIATION WITH US IS COMPLETELY ON A “PAY AS YOU NEED” BASIS UNLESS AGREED AN ALTERNATIVE MONTHLY MEMBERSHIP PLAN.

If you cannot or do not want to accept the new Pupil, you are free to reject our referral and we will not bill you anything for it. A non refundable one-time referral fee of £39 will be charged only when you accept and confirm a booking. We do not demand any security deposit or similar up-front payment of any kind apart from this to ensure you can take as many or as few Pupils as your schedule allows, and only pay for what you really need.

Please note that we reserve the right to re-allocate the Pupil to a different Driving Instructor if you do not contact the Pupil or otherwise respond within 24 hours of receiving the Pupil details from us and/or reject our referral due to any reason.

For the successful processing of your application, please make sure you agree to ALL the points below:

• I confirm that I am appropriately qualified and registered under the UK Driver and Vehicle Standards Agency (DVSA) and will make all relevant license, registration and renewal documentation details available for inspection upon request by Purple Driving School.
• I will ensure that all driving lessons given to the Pupils conform to the latest DVSA recommendations and such other terms, conditions and procedures as may be recommended by Purple Driving School from time to time.
• I will use all reasonable endeavours to promote and improve the reputation of the Purple Driving School and do nothing which may cause any harm or damage to the reputation and goodwill of the same.
• I will contact all prospective Pupils introduced to me by Purple Driving School prior to the scheduled start of the initial lesson to confirm all relevant details, and subsequently make and manage all relevant bookings, appointments and other contacts between the Pupil and myself as and how required.
• I will inform Purple Driving School at least seven (7) days in advance of any dates in regard to which I do not wish to take any initial bookings from prospective Pupils.
• I will inform both Purple Driving School and the Pupil at my earliest opportunity if I am unable to attend any pre-booked driving lesson, and/or make alternative arrangements for the same.
• I will fully comply with all applicable local and national laws, and specifically, will not commit any act nor omit to do any act which constitutes unlawful discrimination under the Sex Discrimination Act 1975, the Race Relations Act 1976, and/or any other Act of Parliament amending, replacing or modifying those Acts.
• I will allow Purple Driving School to periodically send me marketing communication about any promotional and advertising activities carried out by Purple Driving School.
• I will not use a hand-held mobile phone or messaging device at any time during an ongoing driving lesson that may put the Pupils’ and my life at risk.
• I will promptly notify Purple Driving School of any complaint or allegation made against the Driving Instructor of which Purple Driving School ought reasonably to be made aware of, including but not limited to any allegation of commission of a criminal offence (including motoring offences).
• I will, at my own expense provide a Tuition Vehicle fitted with dual controls for imparting driving lessons to the Pupils and ensure that it is in a roadworthy and appropriate condition at all times during driving lessons.
• I will display my ADI (Approved Driving Instructor) or PDI (Potential Driving Instructor) badge in the front windscreen on the passenger side of the Tuition Vehicle at all times during driving lessons.
• I will be responsible for all parking fines or congestion charges (including the payment of all penalty fees or other charges for non-payment) and any other traffic offences (including the misuse of mobile phones) arising in connection with the Tuition  Vehicle.
• I will be responsible for all petrol, fuel, oil, grease, water, anti-freeze and other consumables used by the Tuition Vehicle.
• I will ensure that the Tuition Vehicle is regularly serviced and maintained in accordance with the manufacturer’s recommendations and available for inspection at all times by Purple Driving School subject to reasonable notice.
• I will make prompt payment of all referral fees within fourteen (14) days of receipt of invoice from Purple Driving School.
• I will arrange for appropriate public liability insurance for myself and provide all certified documentation for inspection upon request by Purple Driving School.
• I will be responsible for my own Income Tax and National Insurance liabilities as and where applicable.
• I will indemnify and hold harmless Purple Driving School against any and all claims insofar as they arise out of any fraud, wilful misconduct and/or any other breach of these Terms and Conditions on my part.
• I understand that by agreeing to these Terms and Conditions, I am not receiving any guarantee or warranty by Purple Driving School in connection with the sales volume profitability or any other aspect of my driving instruction business.
• I understand that nothing in these Terms and Conditions shall constitute or be deemed to constitute or imply the existence of a relationship of employment, partnership, agency, profit sharing or such like between Purple Driving School and myself.
• I understand that I have no authority or power to bind Purple Driving School or to make any statement or warranty on behalf of Purple Driving School or to contract in the name of Purple Driving Instructors or to create any other liability against Purple Driving School in any way or for any purpose, except as specifically authorised in these Terms and Conditions.
